These Terms of Use (“Terms”) govern your access to and use of MyFishNavigator (“Service”) at https://www.myfishnavigator.com and related applications operated by Synctuary Works LLC (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Your account

• You are responsible for keeping your login credentials secure and for activity under your account.
• Provide accurate information and keep your email address current.
• Notify us promptly at support@myfishnavigator.com if you suspect unauthorized access.
• We may suspend or terminate accounts that violate these Terms or pose a security risk.

3. The Service

MyFishNavigator helps anglers plan trips using weather, tides, maps, species information, and AI-generated briefings. The Service may include free and paid features. We may add, change, or remove features at any time.

4. Not professional advice

Content from MyFishNavigator — including AI briefings, species suggestions, map pins, and regulations summaries — is for general informational purposes only. It is not a substitute for:

• official fishing regulations, licenses, or creel limits;
• on-water safety judgment, local conditions, or weather warnings;
• professional guiding, legal, or medical advice.

You are solely responsible for verifying regulations with official state, tribal, federal, or local agencies before fishing. Conditions on the water change quickly; always exercise your own judgment.

5. Subscriptions & billing

• Paid plans are billed through Stripe on a recurring basis (monthly or yearly) until canceled.
• Prices and features are shown on our Plans page and may change with notice where required by law.
• You may cancel renewal in Account settings or via the Stripe customer portal; access continues through the current billing period unless otherwise stated.
• Except where required by law, fees are non-refundable once a billing period has started.
• Free tiers may have usage limits (for example, monthly briefing counts).

6. Acceptable use

You agree not to:

• break any law or infringe others’ rights;
• scrape, reverse engineer, or overload the Service without permission;
• upload malware, spam, or content that is unlawful, harassing, or violates privacy;
• misrepresent your identity or impersonate others;
• use the Service to build a competing product using our APIs or content without authorization;
• share account access in a way that circumvents plan limits.

7. Your content

You retain ownership of content you submit (photos, notes, catch logs). By submitting content to features that are shared with other users (such as a community gallery), you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content solely to operate and promote those features. You represent that you have the rights to the content you upload.

We may remove content that violates these Terms or applicable law. You can delete much of your data from Account settings.

8. Our intellectual property

The Service, including software, design, logos, and compiled data presentation, is owned by Synctuary Works LLC or its licensors. These Terms do not grant you any right to our trademarks or to third-party map or chart data except as needed to use the Service personally.

9. Third-party services

Maps, weather, payment processing, authentication, and AI features rely on third-party providers. Your use of those features may also be subject to those providers’ terms. We are not responsible for third-party websites or services linked from MyFishNavigator.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT BRIEFINGS, MAP PINS, OR SPECIES DATA WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR SPECIFIC TRIP.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Synctuary Works LLC AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend and indemnify Synctuary Works LLC against claims arising from your misuse of the Service, your content, or your violation of these Terms or applicable law, except where caused by our gross negligence or willful misconduct.

13. Termination

You may stop using the Service at any time and may delete your account in Account settings. We may suspend or terminate access if you breach these Terms or if we discontinue the Service. Sections that by nature should survive (disclaimers, liability limits, indemnity, governing law) will survive termination.

14. Governing law & disputes

These Terms are governed by the laws of the United States and the State of Minnesota, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence apply. Disputes should first be sent to support@myfishnavigator.com so we can try to resolve them informally.

15. Changes

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Material changes may also be communicated by email or in-app notice where appropriate. Continued use after changes take effect constitutes acceptance.
